How can I renew an international trademark registration?

Renewing an international trademark registration can be done through a process called filing a ‘statement of continued use.’ This document is filed with the United States Patent and Trademark Office (USPTO), which is the federal agency responsible for registering trademarks. Before filing this document, you will need to make sure your mark is still eligible for registration. This means that you must have been using the mark in commerce continuously since the initial registration was granted. You must also make sure that no other party has acquired rights in the trademark since the registration was granted. To file the statement of continued use, you must complete an application on the USPTO website. You will need to provide the following information: the original registration number, the goods/services associated with the mark, the name and address of the registrant or owner, and any evidence you may have of use of the mark in commerce in the United States. Once the statement of continued use is filed and approved by the USPTO, the trademark registration is renewed for an additional 10-year period. This renewal process must be completed before the 10-year renewal period in order to maintain the registration. It is important to understand that renewing an international trademark registration is not the same as registering a trademark in Maryland. To do so, you would need to file a state trademark application with the Maryland Secretary of State’s office. Doing so would provide protection of your mark within the state of Maryland, as opposed to the international protection provided by the USPTO.
