What is a trademark opposition proceeding?

A trademark opposition proceeding is a legal action that can be initiated by one party when they challenge the registration of a trademark by another party. It is a type of legal proceeding that takes place in trademark offices, usually at the state or federal level. In South Carolina, a trademark opposition proceeding is handled by the South Carolina Trademark Office. Before a trademark can be granted, it must be examined by the Trademark Office to make sure that it meets all legal requirements and does not conflict with any existing trademarks. During this examination process, any other party that believes the trademark should not be registered or that their mark has been infringed can file an opposition to the trademark application. The Official Examiner, after hearing all the evidence, makes a decision on whether to approve or reject the trademark registration.
