Is trade secret law different from patent law?
Trade secret law and patent law are two different legal mechanisms that help protect and preserve ideas, inventions, and proprietary information. In Washington, trade secret law is based on state common law, while patent law is based on requirements of the federal government and is regulated by the U.S. Patent and Trademark Office. Trade secret law is designed to keep valuable information and ideas secret from competitors, protecting the competitive advantage of the owner or holder of the secret. It is founded on the state’s law of confidential relationships and requires that the trade secret be kept confidential. A confidential relationship is established when parties agree that certain information should remain confidential. Patent law, however, is designed to promote innovation and to encourage inventors to share their innovation with the public. It grants the inventor exclusive rights to make, use, or sell their invention for a limited period of time. In order to receive a patent, the inventor must disclose their invention to the public in exchange for the patent. In short, trade secret law is used to protect confidential information from competitors, while patent law is used to incentivize inventors to share their inventions with the public. Both have important roles in protecting innovative ideas and inventions.
