Are trade secrets protected in all countries?
No, trade secrets are not necessarily protected in all countries. In the United States, the federal government does not have a uniform law for trade secret protection, so each state has their own laws. In California, trade secrets are protected by the California Uniform Trade Secrets Act (CUTSA). According to CUTSA, a trade secret is “information, including a formula, pattern, compilation, program, device, method, technique, or process, that derives independent economic value, actual or potential, from not being generally known to the public or to other persons who can obtain economic value from its disclosure or use, and is the subject of efforts that are reasonable under the circumstances to maintain its secrecy”. To be protected under CUTSA all trade secret must be kept confidential, meaning that information must not be disclosed or used by an unauthorized person. Outside of the United States, there are trade secret laws in place in other countries. For example, in Europe, the Trade Secrets Directive creates a legal framework for the protection of trade secrets. Additionally, many countries have joined the World Trade Organization (WTO) and abide by the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) which requires that trade secrets be protected. Overall, trade secrets are not necessarily protected in all countries but most countries do have laws in place that provide protection. When doing business in other countries, it is important to be aware of the laws related to the protection of trade secrets.
