What type of information is not protected by trade secret law?

Trade Secrets Law in Texas provides legal protection to valuable information owned by businesses. This law prevents competitors from obtaining confidential information, such as formulas, production methods, customer lists, and other confidential and commercially valuable information. However, not all information is protected by trade secret law. Trade secret law does not protect information that is already publicly known or available to the public. For example, if a company’s formula is available on the internet, then it is not protected by the trade secret law. Similarly, if the information is obtained by fair and honest methods, such as consulting with an expert who is familiar with the industry, then it is also excluded from trade secret law protection. Additionally, information that can be easily reverse-engineered or obtained through reverse-engineering is also excluded from trade secret law protection. Additionally, trade secret law does not protect information that is independently developed by the competitor, regardless of whether the information is similar to the information owned by the business. Finally, trade secret law does not protect information that is revealed by the owner of the information. If the owner of the information voluntarily reveals their information, the competitor is not liable for using or revealing the information. Therefore, it is important to maintain the confidentiality of trade secret information to ensure the protection of the information under the trade secret law.
