What is the process for appealing a traffic ticket?

In South Carolina, if you are issued a traffic ticket, you have the right to appeal the ticket and contest the charges against you. To appeal the traffic ticket, you must first make a written request for an administrative hearing with the South Carolina Department of Motor Vehicles (DMV). You must make this request within 30 days of receiving the ticket, and include the ticket and a $50 administrative fee. When you have requested the hearing, a DMV-appointed hearing officer will hear your case. Your hearing will be conducted in a private, informal setting. During the hearing, you have the right to present evidence, defend yourself and call witnesses to support your case. The hearing officer will then make a final decision. If you are not satisfied with the hearing officer’s decision, you may request a contested case hearing, with a court of law presiding over the case. During the hearing, the court will evaluate the evidence to determine whether the charges against you should be dismissed or reduced. It is important to note that you must follow the appeal process as laid out by the South Carolina DMV. If you fail to follow the process correctly, the officer presiding over your case may not be able to make a decision on your case. Additionally, if you fail to appear in court or at the DMV hearing, your case may be dismissed.
