What is the statute of limitations for contesting a traffic ticket?

Under New York law, motorists have 30 days from the date of issuance of a traffic ticket to file a petition or notice of intention to contest the ticket in court. This time frame is known as the statute of limitations. If the ticket is issued electronically, the statute of limitations is five days from the date of issuance. If mailed, the statute of limitations is 30 days from the date of the mailing. However, the statute of limitations does not start until the ticket is received by the recipient. If the ticket is lost in the mail or otherwise not received, the motorist may be able to fight the ticket beyond the statute of limitations. In addition, motorists may be able to negotiate a longer statute of limitations with the court. However, if the motorist fails to file a petition or notice of intention within the specified time frame, or fails to appear in court, the ticket can be considered a “default judgment” and the motorist can be held liable for the ticket. Finally, if the motorist is able to successfully negotiate a deal with the court to reduce the charge, the motorist may waive the statute of limitations. This means that the motorist will be responsible for paying the ticket and the court will not accept it as a plea to contest the ticket.
