Can I sue another company for unfair competition?

In North Dakota, a lawsuit can be filed against another company for unfair competition. Unfair competition laws are designed to limit and punish certain deceptive or unethical business practices. These practices can include acts such as false advertising, trade secret theft, and price gouging. In order to sue another business for unfair competition in North Dakota, a business must be able to prove that another business has engaged in an unfair practice that is illegal under the North Dakota Unfair Competition Law (NDUCL). The NDUCL prohibits deceptive and fraudulent business practices, as well as some forms of deceptive advertising. If a business believes that another business has broken the NDUCL, then a lawsuit can be filed seeking damages. Additionally, if a company believes that another business has engaged in deceptive advertising or trade secret theft, it may also be able to bring a lawsuit under the North Dakota Deceptive Trade Practices Act (NDDTPA). The NDDTPA prohibits deceptive business practices including false advertising and misappropriation of trade secrets. In summary, it is possible to sue another company for unfair competition in North Dakota. Depending on the type of unfair practice that has occurred, a company may be able to bring a lawsuit under either the North Dakota Unfair Competition Law or the North Dakota Deceptive Trade Practices Act. If a successful lawsuit is filed, then a court may award damages to the party who has been wronged.
