What is a deceptive trade practice?

Deceptive trade practices are illegal acts or omissions made by businesses that are designed to give them a competitive advantage over their competitors. In Florida, these deceptive trade practices are prohibited under the Unfair and Deceptive Trade Practices Act. Examples of deceptive trade practices include false advertising, deceptive pricing, bait and switch tactics, and making false or misleading statements. False advertising involves making representations about a product or service that are inaccurate or misleading. Deceptive pricing occurs when a business charges a different price for a product or service than what is advertised. Bait and switch tactics occur when a business lures in customers with advertisements for a product or service that is not available, but then tries to sell them a different product or service. Making false or misleading statements includes misrepresenting the quality, utility, features, and origin of a product or service. All of these deceptive trade practices are illegal in Florida, and a business found guilty of such practices may be subject to civil penalties.
