What is a deceptive trade practice?
A deceptive trade practice is an illegal business activity in which a company or individual engages in deceptive or misleading practices in order to gain a competitive advantage over competitors. In South Carolina, unfair competition laws, specifically South Carolina Code of Laws Sections 39-5-20 through 39-5-50, regulate such activities. Deceptive trade practices can come in many forms, such as false advertising, or the use of bait and switch tactics. Pyramid schemes involve people paying to join or participate in an organization, with the expectation that they will receive money from those they recruit to the organization. Lastly, trademark infringement is also a form of deceptive trade practice. This occurs when an individual or business uses a trademark (such as a logo, slogan, or brand name) that is already associated with another business. Overall, deceptive trade practices are illegal and can have serious consequences for those who engage in them, including fines and criminal charges. It is important to understand your rights as a consumer and the protections that are in place to safeguard you against unfair competition.
