What is false advertising?

False advertising is when businesses use deceptive information to influence customers to buy their products. It can include phony endorsements, false “bait and switch” tactics, and deceptive pricing. False advertising is against the law in Florida, and the state has many laws in place to protect consumers from businesses engaging in this unfair practice. The Florida Deceptive and Unfair Trade Practices Act makes it unlawful for any company to engage in any false or deceptive advertising, to misrepresent or exaggerate the quality or value of their goods or services, or to fail to disclose any important information in their advertising. It also prohibits businesses from using unfair or deceptive tactics to get customers to buy their products or services, such as using bait-and-switch tactics or misrepresenting their expertise. The Federal Trade Commission (FTC) also has regulations in place to protect consumers from deceptive advertising and other unfair practices. The FTC Act prohibits businesses from misrepresenting or hiding facts in their advertising, and it requires businesses to provide customers with accurate and complete information. If a business is found to be engaging in false or deceptive advertising, they may face stiff penalties. In Florida, businesses can be fined up to $10,000 for each violation of the Deceptive and Unfair Trade Practices Act. Additionally, consumers have the right to file a civil suit against the business for any damages they may have incurred as a result of the false advertising.
