How does the Federal Trade Commission (FTC) regulate unfair competition?
The Federal Trade Commission (FTC) is the federal regulatory agency responsible for protecting consumers from unfair or deceptive practices in the marketplace, including those associated with unfair competition. The FTC is empowered to enforce federal laws that prohibit businesses from engaging in anti-competitive behavior or other practices that could lead to a monopoly. The federal trade commission can take action to stop deceptive or unfair business practices. The FTC has rules governing anti-competitive practices such as price-fixing, bid-rigging, and boycotts. They also enforce the Sherman and Clayton antitrust laws, which prevent companies from forming or attempting to form a monopoly. The FTC also works to protect consumers from fraudulent and deceptive advertising. They have the authority to issue cease-and-desist orders to those companies that engage in misleading advertising. In addition, the FTC can also take civil action against companies that engage in unfair competition practices by seeking an injunction preventing further violations. This move would require the offending company to reimburse its victims and/or to award the FTC’s costs and attorneys’ fees, among other remedies. In North Dakota, the FTC has the power to investigate and enforce unfair competition laws. For instance, in 2006, the FTC entered into settlements with two North Dakota telemarketers who had used deceptive tactics to make millions of dollars in sales of bogus products. As part of the settlements, the two companies had to refund more than $1 million to consumers.
