What is a tortious interference with contractual relations?
Tortious interference with contractual relations is a form of unfair competition law that prohibits people from interfering with existing contracts between two parties. In Kansas, tortious interference with a contract, also called “economic interference,” is a form of civil wrong that one can be held liable for. This means that a person or business can be held responsible for losses caused by their intentional interference with a contractual relationship. Tortious interference with contractual relations typically occurs when one party interferes with an existing contract, either by persuading one of the parties to break the contract or by intentionally preventing one of the parties from fulfilling the contract. A successful claim for tortious interference with a contract requires the plaintiff to prove that the defendant (1) knew about the contract; (2) took action with the intent to interfere; (3) caused a breach of the contract; and (4) caused the plaintiff to suffer some form of harm. When one party is found to have interfered with an existing contract, they can face a number of consequences, such as being ordered to pay damages for the harm caused by the interference. If the interference was done deliberately, punitive damages may also be awarded. In Kansas, tortious interference with contractual relations is a serious form of unfair competition law that can have serious repercussions for those found guilty of violating it.
