Tortious interference with prospective business relations (or prospective economic advantage) is a type of Unfair Competition Law in Florida. It occurs when one business intentionally interferes with another’s ability to do business. This can include stealing customers or trade secrets, giving false information about the company, and even persuading a customer or partner to breach their contract. If a company or individual is found guilty of tortious interference with prospective business relations, they could be liable for damages, including reputational harm, lost profits, and even punitive damages. To be successful in a tortious interference claim, the harmed business must be able to prove that the defendant acted intentionally and without justifiable cause. In Florida, an individual or company can be held liable for tortious interference with prospective business relations in many different situations. This includes situations in which a customer is persuaded to break his or her contract with the business, a competitor spreads false information about the business or the employees of the business, or a company attempts to influence or persuade customers away from the business.
