What is an unfair competition trial like?
An unfair competition trial in Pennsylvania is a legal process designed to prevent unlawful business practices in the marketplace. During the trial, both parties present their case and the court will decide which one is the fair competitor. The defendant’s case is usually presented first. The defendant must provide evidence to show that they have not violated any laws, and are not engaging in unfair competition. This is typically done by showing the court how the defendant’s business practices are similar to those used by other businesses in the area. Next, the plaintiff must present evidence to show why their business is being harmed by the defendant’s practices. The plaintiff must explain why they are being harmed and the amount of damages they are suffering, if any. Once both sides have presented their cases, the court will usually hear closing arguments from each party. After this, the judge will rule on whether or not the defendant is guilty of unfair competition, and decide how much compensation the plaintiff should receive.
