What is the law of comparative advertising?

Comparative advertising is a marketing technique which involves a company comparing their goods or services directly with those of another company. It is a legal practice in the United States, but it is regulated by what is known as the Unfair Competition Law in Maryland. Under the Unfair Competition Law, companies may compare their products to compete with their competitors, but these comparisons must be made fairly and accurately. Comparisons must not contain false or misleading information, and must not misrepresent the products or services of the competitors. The comparison must be presented in a way that does not unfairly discredit or take advantage of the competition. The Unfair Competition Law also states that any advertisement which presents an unfavorable opinion of a product or business must be clearly identified and based on fact. As such, this law prevents companies from using deceptive practices to make their products look better than their competition. It also protects consumers from false or misleading advertising. In summary, the Unfair Competition Law in Maryland protects consumers and prevents companies from engaging in unfair and deceptive practices. Comparative advertising is an effective way for companies to market their products and services, but it must be done fairly and accurately in order to comply with the law.
