Are there any special rules for protecting trade secrets?
In New Hampshire, there are special rules protecting the trade secrets of businesses. These rules are contained in the Unfair Competition Law and aim to protect businesses from unfair or deceptive practices by competitors. The Unfair Competition Law establishes a general prohibition against using any method that is deceptive, unfair, or fraudulent for the purpose of obtaining or attempting to obtain business. Specifically, this law prohibits the misappropriation of trade secrets, which are defined as information that is not generally known or ascertainable by proper means, confidential information that has a particular value because it is not generally known, or a formula, pattern, compilation, program, device, or method used in a business. In addition to this general prohibition, the law also prohibits the acquisition of a trade secret by improper means, such as theft, bribery, misrepresentation, breach of confidence, or espionage. Furthermore, there is a specific prohibition against the use or disclosure of a trade secret obtained from or through another person who is under an obligation to keep it a secret. Finally, a person who violates any of the aforementioned prohibitions may be liable for damages, including court costs and attorneys’ fees, as well as any profits or other gains that may have been realized due to the misappropriation of the trade secret. In addition, the court may issue an injunction or other equitable relief in order to prevent further disclosure of the trade secret.
