How does the Anticybersquatting Consumer Protection Act protect against unfair competition?

The Anticybersquatting Consumer Protection Act (ACPA) is a law that was passed by Congress in 1999 to protect consumers from fraudulent and deceptive practices related to online businesses, such as registering domain names with the intent to profit from someone else’s trademark. ACPA provides a legal remedy to trademark owners who discover that someone else has registered a domain name that is identical or confusingly similar to their trademark. Under this law, a trademark owner or its representative can file a lawsuit against a cybersquatter who registers, traffics in, or uses a domain name that is identical or confusingly similar to their trademark in bad faith. ACPA provides protection for two types of harm to trademark owners: interference with the use of the trademark, and free-riding on the goodwill associated with the trademark. If the plaintiff prevails in the suit, the cybersquatter may be ordered to transfer the domain name and pay damages. In addition, ACPA makes cybersquatting a criminal offense, punishable by prison time and/or fines. This law is especially important in Texas, where unfair competition can occur with the use of deceptive acts that harm consumers or other businesses. By protecting trademark owners from cybersquatting, ACPA helps to protect Texas consumers and businesses from the deceptive and fraudulent practices of cybersquatters.
