What is the definition of “unfair trade practices”?
In Delaware, “unfair trade practices” are defined as methods used by businesses to gain an unfair advantage over their competitors in the marketplace. These practices may include false advertising, misrepresenting a product or service, failing to provide accurate information about an item for sale, or a number of other tactics that are designed to give the business an edge over the competition. The Delaware Unfair Competition Law (7 Del. Code, Title 6, Section 20) specifically outlines a list of these practices that are considered unfair. These practices include the use of false or misleading information, bribery, misrepresenting goods or services for sale, and acts that are meant to disrupt the market for a certain product or service. This list also includes activities that can result in deceptive practices, such as the use of bait and switch tactics and the use of deceptive pricing. Unfair trade practices in Delaware are prohibited by law. Businesses can face fines and other penalties if they are found to have violated this law. However, businesses must be able to prove that their actions were deliberate and that they were trying to gain an unfair advantage in the marketplace in order for these penalties to be imposed.
