What are the elements of a false advertising claim?

The third element is that the false statement was material, meaning it was likely to influence a person’s decision to purchase the product. The statement should be one that a reasonable person would find important in deciding whether or not to buy the product. The fourth and final element is that the false statement was intended to result in an unfair advantage. This means that the company making the statement was hoping to gain customers or sales at the expense of a competitor. In order for a false advertising claim to be successful in Florida, all four of these elements must exist. If any of them are missing, the claim will likely not hold up in court.
