What are the remedies available in a UDRP claim?
In Arizona, the remedies available in a UDRP claim are outlined in the Anticybersquatting Consumer Protection Act (ACPA). If the claimant is successful in proving that a domain name was registered with bad faith intent, three remedies are available. First, the court can order the domain name registrant to transfer the domain name itself to the claimant. This remedy usually happens when the registrant has no intention of making productive use of the domain name and is using it to exploit the goodwill of the claimant. Second, the court may award damages to the claimant for any losses incurred due to the domain name registration. These damages could include actual financial losses, such as payments for misdirected web traffic, as well as damages for emotional distress, reputational damage, or lost business opportunities. Third, the court may grant an injunction to prevent the registrant from continuing to use the domain name.
