What are the remedies available in a UDRP claim?
If an individual or business in Texas believes they’ve suffered economic harm due to a competitor’s unfair competition, they may pursue a claim under the Texas Unfair Competition Law (UCL). Under the UDL, plaintiffs can seek both compensatory and injunctive relief. Compensatory relief is a monetary award to the plaintiff for the losses they incurred as a result of the defendant’s actions. Injunctive relief is a court order prohibiting the defendant from engaging in unfair practices in the future. Compensatory damages in a UDL suit may include the plaintiff’s lost profits, restitution of the defendant’s profits or any other losses suffered by the plaintiff. Injunctive relief may also be sought by the plaintiff in a UDL suit. This could include an order against the defendant to stop the unlawful practices, require the defendant to pay the plaintiff’s attorney fees and costs, or an injunction to require the defendant to produce documents or other information needed for the case. The remedies available in a UDRP claim, however, may differ depending on the facts of the case. Depending on the legal claim, plaintiffs may be able to request monetary damages, a temporary restraining order or a permanent injunction. Additionally, plaintiffs may be able to recover costs and attorney fees if they are able to establish the claim is valid.
