How does trademark law protect against trademark infringement?

Trademark law is designed to help businesses protect their trademarks from being used without permission by another business. This is known as trademark infringement. Trademark law helps protect businesses from competitors who try to copy their name, logo, or other identifying symbols in order to confuse customers. Trademark infringement is illegal because it interferes with a business’s ability to benefit from the goodwill it has built up around its brand. When customers are confused as to the origin of a product or service, it not only disrupts the business’s ability to make money, but it can also damage the reputation of the original business. In Maryland, the federal Lanham Act permits a business to sue a competitor who is intentionally using their trademark without authorization. The Lanham Act also allows a business to seek an injunction, which is a court order that prevents a competitor from continuing to use the mark in dispute. A business can also demand monetary damages for loss of profits or reputation due to trademark infringement. In addition, the Maryland Uniform Deceptive Trade Practices Act protects businesses from deceptive and fraudulent business practices, including trademark infringement. The Act allows a business to recover damages from a competitor who is trying to confuse customers by using their trademark without authorization. By protecting trademarks from infringement, trademark law helps businesses maintain their goodwill and reputation, while also ensuring that customers are not confused or deceived.
