How does the Lanham Act protect against trademark infringement?

The Lanham Act is a federal law that protects businesses from trademark infringement in the United States, including Maryland. It prohibits the unauthorized use of trademarks, logos, or other symbols that could cause confusion about a company’s products or services or make it difficult for consumers to differentiate one company’s products or services from another’s. The Lanham Act offers two types of protection: 1. Trademark Infringement. This protects against the unauthorized use of a trademarked word, phrase, symbol or logo. If someone uses a trademark that is already registered or pending such as a sound, color, shape, or smell associated with a brand, the Lanham Act protects the rights of the owner to stop others from using that mark. 2. Unfair Competition. This protects against any conduct that is likely to cause confusion among customers, such as false advertising or passing off a product as belonging to a competitor. If someone is found to be infringing on a trademark or commiting an act of unfair competition, the Lanham Act allows for remedies such as monetary damages, injunctions, and seizure of infringing products. It is important for businesses to register their trademarks in order to receive the full protection of the Lanham Act.
