What is constitutional law?
Constitutional law is a body of law that establishes the structure of government, defines the powers and responsibilities of the government, and the rights of citizens in North Carolina. It is derived from the state and federal constitutions and Supreme Court rulings. Constitutional law is important because it provides citizens with protection against government abuse or violation of their rights. Constitutional law includes the authority of the government to pass laws that protect citizens from harm, such as criminal punishment or civil damages when someone violates laws. It also establishes the framework for the federal and state governments, and sets limits on what each one can do. This includes the separation of powers between the executive, legislative, and judicial branches of the government. Constitutional law also grants citizens certain fundamental rights, such as freedom of speech, religion, and press. These rights are guaranteed in the First Amendment of the US Constitution and are referred to as civil liberties. This means that they cannot be taken away or limited by the government without due process. Constitutional law has had a long history in North Carolina. Its roots trace back to the state’s original constitution of 1776. Since then, the North Carolina constitution has been amended and updated numerous times to reflect the evolving needs of the state. Today, the state constitution serves as the foundation of North Carolina’s government and its citizens’ rights.
