What is the difference between federal and state constitutional law?
The main difference between federal and state constitutional law is the scope of its application. Federal constitutional law applies to all states, whereas state constitutional law is specific to the state that created it. For example, the U.S. Constitution outlines the rights of citizens and sets the federal government’s powers. The Louisiana state constitution outlines the rights and duties of its citizens and establishes the powers of the state government. Also, federal constitutional law is mainly based on the U.S. Supreme Court’s interpretations and rulings, while state constitutional law is based on the state’s judicial system’s interpretations and rulings. So for example, the U.S. Supreme Court might have a ruling on the Second Amendment, while the Louisiana Supreme Court will have a ruling on the state’s equivalent of the Second Amendment. Finally, another difference is that federal constitutional law trumps (or overrules) state constitutional law. So if the state’s interpretation of its constitutional rights conflicts with the federal interpretation, the federal interpretation will reign supreme. This is important in order to maintain consistency and equality between states and the federal government.
