What is the scope of the takings clause of the Fifth Amendment?
The Takings Clause of the Fifth Amendment states that “private property [shall not] be taken for public use, without just compensation.” In the state of New Mexico, this clause generally applies to government actions that interfere with a person’s right to possess and use their private property.
