What is the scope of the right to jury trial under the Seventh Amendment?

The Seventh Amendment to the United States Constitution guarantees the right to a jury trial for certain civil cases. This right is applicable to the federal courts, but has been implemented in some form in most state court systems as well. The scope of the Seventh Amendment’s jury trial right arises from a legal concept known as “jury trial of right.” This type of jury trial exists when the parties have the right to have their case tried before a jury, regardless of whether the parties agree or not. Finally, the Seventh Amendment does not guarantee a jury trial for all damages claims. In order for a damages claim to qualify for a jury trial under the Amendment, the amount at stake must be more than a certain amount. This amount is determined by federal and state laws, depending on the jurisdiction. Therefore, a plaintiff may be able to bring a damages claim without having a jury trial if the amount claimed is not high enough to meet these limits.
