How has the Supreme Court interpreted the Ninth Amendment of the US Constitution?
The Ninth Amendment of the US Constitution reads as, “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.” This amendment serves as a reminder that the listing of rights in the Constitution does not mean that those are the only rights citizens have. In recent decades, the US Supreme Court has applied the Ninth Amendment in a number of cases to protect individual rights even though those rights were not specifically listed in the US Constitution. In the 2020 case of June Medical Services v Russo, the court found that the state of Louisiana’s law, which restricted abortion access, violated the Ninth Amendment. The Supreme Court argued that the Ninth Amendment protected the right to make decisions about one’s own body, including the right to seek an abortion. In other cases, the Supreme Court has relied on the Ninth Amendment to protect the right to die, the right to receive contraception, and the right to receive psychiatric care. In short, the US Supreme Court has interpreted the Ninth Amendment to protect individual rights that are not explicitly mentioned in the US Constitution. By doing so, the Supreme Court has expanded personal liberty and ensured that individual rights are protected even when they are not specifically listed in the US Constitution.
