How do I appeal a decision on my disability benefits claim?

If you have filed a claim for disability benefits from the United States Department of Veterans Affairs (VA) in Delaware and have been denied, you have the right to appeal the decision. In order to appeal, you must submit a Notice of Disagreement (NOD) within one year of the date your VA notification letter was sent to you. You can submit your NOD in writing, by visiting the Delaware Regional Benefit Office, or by submitting an NOD form online. Once the VA has received your NOD, they will defer to the Board of Veterans’ Appeals (BVA) to review your claim and make a decision. During the appeal process, you may be asked to provide additional evidence to support your claim. After the BVA has reviewed your evidence, they will issue an appeal decision, which you can either accept or further appeal. If the BVA does not rule in your favor, you have the option to appeal their decision to the Court of Appeals for Veterans Claims (CAVC). When appealing to the CAVC, you must submit a written statement as to why you disagree with the BVA’s decision. Throughout the appeals process, it is important to remember that you have certain rights, including the right to be represented by a lawyer and the right to submit additional evidence. If you feel that the VA’s decision was not made in good faith, you may wish to seek legal advice.
