How do I appeal a decision on my disability benefits claim?
If you are a veteran in South Carolina and you are unhappy with a decision made on your disability benefits claim, you may be able to appeal the decision. To start the appeal process, you must file a Notice of Disagreement (NOD) with the Veterans Affairs Regional Office (VARO). This is a form that states you think the decision on your disability benefits claim is wrong and you wish to appeal. After you file the NOD, you will receive a letter from the VA that will explain your appeal options. If you disagree with the decision but decide not to appeal, you will end the process and the decision will remain unchanged. If you choose to appeal, you will need to select one of three options: • Supplementary Evidence – With this option, you will submit additional evidence to the decision maker in support of your claim. • Higher-level Review – With this option, you will submit a written request to have the decision reviewed by a higher-level reviewer who was not involved in the previous decision. • Board of Veterans’ Appeals – With this option, you will have a hearing with a Veterans Law Judge. Depending on your appeal option, the VA may schedule a medical or psychological exam. You can also ask for the VA to provide you with a copy of your file in order to review the evidence used to make the decision. If you are not sure you understand the appeal process, you should consult with an attorney who specializes in Veterans Disability Law. They will be able to explain the appeal process in greater detail and advise you on the best course of action.
