What happens if my claim is denied?

If your claim for veterans disability benefits is denied by the California Department of Veterans Affairs (CDVA), you have the right to appeal the decision. You must first file a Notice of Disagreement (NOD) and then complete a Request for Reconsideration (RFR). The RFR includes a statement explaining why you believe the CDVA made a mistake and evidence that supports your case. Once your RFR is filed, the CDVA will review all the evidence presented and make a final decision. If the decision is still unfavorable, you may appeal to the Board of Veterans Appeals and/or to the California State Court system. When appealing to the Board of Veterans Appeals, you will need to explain your case to a Veterans Law Judge who will review the evidence and make a final decision. If the Board decides against you, you may appeal to the US Court of Appeals for Veterans Claims or to a US Federal District Court. At any stage of the appeals process, you should hire an experienced veterans disability attorney to represent your case and fight for the compensation you deserve. You have a much better chance of success if you have a knowledgeable attorney to represent you.
