What is a veterans appeals process?

A veterans appeals process is a way for veterans to seek benefits or higher compensation for their disability rating. In Hawaii, veterans who believe they have been wrongfully denied benefits or have a disagreement with the rating they have been given can appeal their case to the U.S. Court of Appeals for Veterans Claims (CAVC). When appealing to the CAVC, the veteran must submit a notice of disagreement to the Regional Office in Honolulu. The Regional Office then produces a statement of the case, which the veteran then has 60 days to appeal to the CAVC. Once the appeal is filed, a judge will review all the evidence and arguments, and hear oral arguments from both sides. The veteran may be represented by an attorney or an accredited representative. Once the judge issues a opinion, the veteran has the option to file a petition for reconsideration. This is a request for a different judge to review their case and the evidence presented.
