What is a veterans appeals process?
A veterans appeals process is the process in which a veteran can appeal a decision made by the Department of Veterans Affairs (VA) regarding his or her disability status or benefits. If a veteran disagrees with a decision made by the VA, he or she can file an appeal and request a review of the decision. The veterans appeals process in North Carolina starts with the veteran filing a Notice of Disagreement (NOD) with the VA. The NOD must include the veteran’s name, the date of the decision, the reason for the disagreement, and the specific action requested. The VA will then forward the NOD to the Board of Veterans’ Appeals (BVA), which is the central processing arm of the VA. The BVA will review the case and send a rating decision to the veteran and the veteran’s representative. If the veteran does not agree with the decision, he or she can file an appeal with the Court of Appeals for Veterans’ Claims (CAVC). The veteran must file an appeal within 120 days from the date of the Board decision. The veteran may also file an appeal with the U.S. Court of Appeals for Veterans’ Claims (USCAVC). The USCAVC is the highest court for veterans law in the United States and it allows the veteran to appeal a final decision by the BVA. Once all steps of the appeals process have been completed, the veteran can expect to receive a final decision from the USCAVC within 18 months to 2 years.
