What is a waiver of overpayment?

A waiver of overpayment is a legal document that allows veterans with disabilities who are eligible for disability payments in Alaska to keep payments they may have received in excess of what they were actually entitled to. In other words, a waiver of overpayment is an agreement between the veteran and the U.S. Department of Veteran Affairs (VA) that the VA won’t take the money back from the veteran that was paid in error. This is important because if a veteran receives an excess payment, they can face severe financial hardship if the money must be paid back. When a veteran is issued a waiver of overpayment, they are also given up to twelve months to pay back the debt in monthly installments. The veteran will also not face collection efforts or other negative consequences during this period of time. In order to be eligible for a waiver of overpayment, the veteran must meet certain criteria. These criteria include having a VA disability rating of at least 10%, being found to have received the overpayment through no fault of their own, and having limited income and resources. The veteran must also submit an approved application and a written statement detailing why they believe they should be granted a waiver of overpayment.
