What are the requirements for a presumption of service connection?

In Alaska, the requirements for a presumption of service connection for veterans disability law are as follows. The veteran must have served 90 days or more in active duty with at least one day during a period of war as declared by the President. The veteran’s disability must have either appeared during service or have been aggravated while serving. The veteran must also show that the disability is related to, or caused by, an event that occurred during their service. The Veteran must also have a current disability that is considered at least 10% disabling. If the disability is rated as 0%, further medical evaluation is required to establish a service connection. The veteran must provide evidence of exposure to hazards common to war, such as toxins, radiation, and hazardous materials, which may be responsible for causing or aggravating the veteran’s disability. If the veteran meets all of these requirements, they are eligible for a presumption of service connection, which means that the veteran is not required to provide evidence of the direct link between their service and their disability. In this case, the VA will assume the disability occurred during active duty. The veteran must still submit an application and provide documentation and evidence to support their claim. If the veteran does not meet the above requirements, they can still file a claim for service-connected disability, but they must provide evidence to prove the connection.
