What are the requirements for a presumption of service connection?

The presumption of service connection is a legal term used to refer to a situation where a veteran is deemed to have a particular medical condition due to their service in the military. In New York, a veteran must prove the following in order to be eligible for the presumption of service connection: 1. The veteran must have been discharged or released from service with an honorable or general discharge. 2. The veteran must have to have suffered an injury or experience an onset of an illness during active duty service. 3. The veteran must have a current medical diagnosis showing that the particular condition they are seeking disability benefits for is likely related to the injury or illness they experienced during active service. 4. The veteran must provide evidence showing that the condition was aggravated during or caused by their military service. These four pieces of evidence are necessary for the Veterans Benefits Administration to presumptively grant service connection. If a veteran meets the four requirements listed above, they should be granted service connection and entitled to the disability and medical benefits they are seeking.
