What happens if my appeal is denied?
If your appeal of your veterans disability claim is denied, you have the right to request a hearing with a U.S. Department of Veterans Affairs (VA) Judge. In most cases, this hearing is an informal conversation with the judge. However, if the VA denies your claim, you can typically request a formal hearing in which you can present evidence and make arguments. In Florida, the VA regional office is responsible for handling your appeal. The VA Appeals Management Center will review your appeal and make a decision. If you disagree with the VA decision on your appeal, you can request an appeals conference before an Administrative Law Judge (ALJ). The ALJ will review the facts of your case and make a decision regarding your claim. The ALJ may also decide to schedule a hearing if they need more evidence from you. At the hearing, both your lawyer and the VA lawyer will present their arguments and evidence. The ALJ, or a panel of ALJs, will determine whether your appeal should be granted or denied. If your appeal is denied, you still have the option to file a motion for reconsideration or an appeal to the U.S. Court of Appeals for Veterans Claims. This process can be long and complex, so it is important to consult with an experienced attorney before deciding whether to take this step.
