What happens if my appeal is denied?
If your appeal for a Veterans Disability benefit is denied in Washington, it does not mean that you are completely out of options. You will receive a letter of denial which will explain the reasons why your appeal was denied. You can then file a reconsideration request with the VA which will be a chance to present your case again. If the reconsideration request is also denied, you can appeal to the Board of Veterans Appeals. This is the highest level of appeal within the VA. After the Board of Veterans Appeals reviews your case, they will issue a decision that is either favorable or unfavorable. If the Board of Veterans Appeals denies your appeal, you can then file a civil action lawsuit in a Federal court. This is the final step in appealing an unfavorable VA disability decision. At each level, it is important to remember that you are allowed to have legal representation to assist with your appeal.
