What is the difference between first degree and second degree murder?

In South Carolina, first degree murder is classified as a premeditated killing or one that is carried out with an intent to kill. This type of murder carries a much harsher punishment than other types of homicide. This includes a sentence of life in prison without the possibility of parole. Second degree murder is defined as an intentional killing that is not premeditated, or a killing that is a result of an act that carries a substantial risk of death. This type of murder can carry a sentence up to 30 years in prison. The main difference between first degree and second degree murder is the level of intent. In first degree murder, the offender had an intent to kill from the start. On the other hand, second degree murder does not require an intent to kill from the start and is usually the result of an act that carries a substantial risk of death. In both cases, the offender is held responsible for their actions and can face severe consequences.
