How are breaks and overtime calculated?
In North Dakota, overtime is calculated based on hours worked in a week. An employee must be paid one and a half times their regular hourly rate for any hours worked over 40 in a week. Employees must be given a minimum of 30 minutes of break for every 8 hours worked. They are not required to be paid for this break time, as long as the employee is completely relieved of their duties during the break period. However, if the employee is required to work during their break period, it will be considered part of their hours worked and they must be paid for it. Different types of employment, such as salaried employees, or employees who work a shift longer than 8 hours, will have different rules about overtime and breaks.
