What workers are not entitled to overtime pay?

Under Nevada’s Wage and Hour Law, certain workers are not entitled to overtime pay. These are primarily employees who work in an administrative, executive, or professional capacity, and are accordingly classified as exempt. These exempt employees include those who are paid on a salary basis, and have been hired in particular positions such as executive, administrative, professional, outside sales people, and certain computer-related positions. Exempt employees are not entitled to overtime pay as their job responsibilities and duties pay them at a rate that is higher than the overtime rate. Additionally, they do not track their time on the job and are usually paid more than the minimum wage. Overtime laws do not apply to these workers, nor do they receive any benefit from overtime pay. Furthermore, certain employees who are classified as independent contractors are not eligible for overtime pay. This includes those who are self-employed, and those who contract with a business to provide specific services. These individuals are generally not eligible for overtime pay because they are not considered employees of the company and cannot be subject to the overtime laws. This is why employers should be careful to understand the difference between an employee and an independent contractor. These are just some of the workers who are not eligible for overtime pay under Nevada’s Wage and Hour Law. Ultimately, employers must thoroughly review the job description of each worker and determine if overtime laws apply.
