Is it legal to dock an employee's pay for violating a policy?

In Louisiana, an employer may not dock an employee’s pay without authorization from the state. Louisiana’s Wage Payment Law states that an employee may not be penalized or have their wages reduced for any reason if the penalty is not authorized by law. This means that an employer cannot dock the wages of an employee for violating policy unless a similar penalty is provided in the employee’s written agreement or is authorized by law. For instance, if an employee violates a policy that requires them to arrive to work on time, the employer is not allowed to dock their wages in penalty. However, the employer may be allowed to dock the employee’s wages if the employee is late to work more than twice in a month and the employer specifically stated this consequence in the employee’s written agreement. In addition, employers are not allowed to dock an employee’s wages for any kind of damages or losses unless the employer has legally obtained a court judgment that authorizes the deduction. If an employer mistakenly makes an unauthorized deduction from an employee’s wages, the employee is eligible to recover double the amount of damages they suffered. In summary, it is important to check both state laws and employee written agreements in order to determine if an employer can legally dock the wages of an employee for violating policy. Unless a penalty is authorized by laws or in the employee’s written agreement, it is illegal for an employer to dock an employee’s wages in Louisiana.
