What are the employer’s responsibilities for paying minimum wage?
In Illinois, employers are legally required to pay their employees at least the minimum wage, which is currently set at $9.25 per hour. Employers must pay wages at least twice a month, and wages must be paid in regular increments that are consistent from one pay period to the next. Employees must be paid on the regular payday and cannot wait more than 10 days after the last day of a workweek or pay period for their wages. The minimum wage set by the state is the lowest wage an employer can legally pay any employee. Employers who pay less than the minimum wage are in violation of the law and can face serious penalties. The state can take legal action against employers who fail to comply with wage laws, which may include the payment of back wages and fines or imprisonment. Employers must also pay tipped employees a minimum wage of at least $4.95 per hour before tips. If the tips earned plus the base wage is less than the state minimum, the employer is required to make up the difference. Employers are also responsible for keeping accurate records of their employees’ wages and hours worked, which can be used to prove compliance with wage and hour laws. Accurate records are also necessary to protect employers from liability in the event of a dispute over wages or hours worked. Employers must also provide their employees with statements showing the amount of wages paid and deductions made to their pay.
