Are employers required to provide sick leave to employees?
In Massachusetts, employers are required to provide sick leave to employees. The Massachusetts Earned Sick Time Law (MESTL) requires employers to provide paid sick leave to employees. This law applies to employers with 11 or more employees and it also applies to employees who work in Massachusetts. The law requires employers to provide up to 40 hours of paid sick time in a 12-month period, with some exceptions. Employees are entitled to use the paid sick leave for their own illness, or to care for a family member. Eligible family members include parents, children, spouses, or domestic partners. Employees must provide their employer with at least 7 days of advance notice if they are going to use the sick leave. Employees may also be entitled to receive up to three days of unpaid sick leave per year. The Massachusetts Minimum Wage and Pay Equity Law also covers sick leave. Under this law, employers with 6 or more employees must provide employees with up to 40 hours of unpaid sick leave per year. This leave can be used for medical or family purposes.
