How is water law enforced?

Water law is enforced in North Dakota to ensure that the state’s water resources are used and managed properly. These laws, which are overseen by the North Dakota State Water Commission, create a set of rules that all water users must follow. The State Water Commission is responsible for the enforcement of North Dakota water laws. It has the authority to investigate and cite any water users for violations. If a water user is found guilty of violating water laws, they may be subject to fines, suspensions, revocations, or other consequences. The State Water Commission also has the authority to issue permits and/or licenses to any water users. Permits and licenses are required for activities such as diverting water from rivers, using water on private land, and using water for irrigation. Without a permit or license, any water use is illegal and could result in fines or other consequences. The State Water Commission also regularly inspects water resources to ensure their proper use and management. Water users must work with the commission to ensure that their water use does not conflict with laws and regulations. In addition, the North Dakota State Water Commission has the authority to take legal action in cases of water pollution or other water-related issues. Individuals or entities that are found guilty of polluting or misusing North Dakota’s water resources could face prosecution and could be subject to civil and/or criminal penalties.
