What is groundwater law?

Groundwater law in Kentucky is the area of law which covers the regulation of groundwater usage in the state. Groundwater law generally covers the rules and regulations under which a person may access, use, and maintain their water rights. Under Kentucky water law, groundwater is an “appropriable” resource, meaning that the water can be accessed and appropriated for a variety of uses. Groundwater law in Kentucky establishes the ways in which people can access and use groundwater, as well as who has the right to use it and for what purposes. Groundwater law also establishes guidelines for how much water can be taken from a source, how it can be used, how it should be managed or protected, and who is responsible for maintaining the groundwater resource. Groundwater law also sets out rules for the prevention of water pollution and for water conservation. These laws are designed to ensure that the environment is not harmed from the use of groundwater and that the resource is managed in an equitable manner. The regulations and laws for groundwater usage in Kentucky are established through the Kentucky Department of Environmental Protection and the Kentucky Energy and Environment Cabinet. These regulations set out the requirements for the proper and sustainable use of groundwater, and provide rules for how water rights should be managed.
