How does groundwater law regulate inter-basin transfers?
In Washington, the law regulating inter-basin transfers of groundwater is known as the Groundwater Management Act of 1975 (GMA). This act regulates the transfer of water between two basins, or between two areas of the same basin, when the flow of water is from a higher density area to a lower density area. This law is intended to protect existing groundwater resources and ensure balance between basins. The GMA requires an individual or entity who wishes to transfer water from one basin to another to obtain a Water Right Certificate from the Washington Department of Ecology. This certificate outlines the terms of the transfer, including the amount of water that can be withdrawn, how the water will be used, and how much the transfer will cost. It also requires the individual or entity to prove the transfer is beneficial and economically reasonable. Once approved, they are then issued a permit that authorizes the inter-basin transfer. The GMA also includes measures to protect existing groundwater resources in the transferring basin. This includes requiring the permit holder to complete a study that analyzes the effects of the transfer on the environment, such as the potential for reduced water quality or depletion of the water table. The permit holder is required to develop a plan to protect existing resources and to ensure the water is being used for beneficial purposes. Inter-basin transfers of groundwater are regulated to ensure the protection of existing resources and balance between basins. The process and regulations set forth by the GMA are intended to safeguard Washington’s water supply and protect the state’s water resources.
