How is foreclosure fraud committed?

Foreclosure fraud is a type of white collar crime that occurs when an individual attempts to defraud lenders or homeowners during the foreclosure process. Fraud can be committed through various methods, such as misrepresenting the status of the foreclosure proceedings, failing to disclose information about the property or owner, or providing false information to potential buyers. In South Dakota, foreclosure fraud is most commonly committed when individuals illegally occupy a foreclosed home or property. By occupying the property, the perpetrator is preventing the rightful owner or lender from taking action to recover the property and resulting profits. Other forms of foreclosure fraud include a perpetrator posing as a representative of the lender or homeowner in order to gain access to a foreclosure property. The perpetrator may then access valuable documents and information about the property, or even try to resell the property for their own profit. False claims of bankruptcy or foreclosure can also be made by perpetrators in order to take advantage of homeowners or lenders. Additionally, perpetrators may falsely claim to represent a lending services company in order to gain profits from distressed homeowners. To protect lenders and homeowners from foreclosure fraud, the South Dakota attorney general recommends that lenders and owners take advantage of consumer protections and immediately report any suspicious behavior to local law enforcement. It is also important to be cautious when dealing with foreclosure proceedings, and to do research to ensure that the representative that is helping with the foreclosure is legitimate. Individuals should also be sure to verify any contracts that are being signed before agreeing to any deals, and to review any paperwork generated in the foreclosure process carefully.
