What is the difference between an indictment and an information?
In Tennessee, indictments and informations are both documents filed in court that contain formal charges against a person. The main difference between an indictment and an information is in the way they are filed. An indictment is filed by a grand jury in a criminal case and typically happens after an investigation. It is a formal accusation that a person has committed a crime. Indictments must be returned by 12 or more grand jurors in order to be valid. An information, on the other hand, is generally filed by a prosecutor and may be done after an arrest. It is a formal accusation that a person has committed a crime and the defendant is notified in writing. Unlike indictments, informations do not require a grand jury’s approval. In some cases, a defendant may waive the right to a grand jury and allow a prosecutor to file an information. In Tennessee, white collar crimes are investigated by special agents from agencies such as the FBI, Secret Service, and IRS. After an investigation, prosecutors may file an indictment or information against defendants for committing white collar crimes.
